To the creditors against Alpha Insurance A/S

Please be advised that on 8 May 2018 the bankruptcy division of the Danish Maritime and Commercial High Court commenced bankruptcy proceedings against Alpha Insurance A/S.

The bankruptcy court appointed Attorney Boris Frederiksen, Vester Farimagsgade 23, 1606 Copenhagen V, Denmark, as the trustee.

The company carried on insurance and reinsurance business in non-life insurance.

I draw the creditors‘ attention to the wording of section 108(2) of the Danish Bankruptcy Act:

“The creditors‘ meeting to elect the trustee and the creditors‘ committee must be con- vened if so requested by the trustee or a creditor. A request to this effect must be sub- mitted in writing to the bankruptcy court no later than 3 weeks after the publication of the bankruptcy notice, see section 109. The creditors‘ meeting must be held no later than 3 weeks following receipt of a request to this effect. The bankruptcy court will immediately publish a notice on the creditors‘ meeting in the Danish Law Gazette.

As for the notice, I note that the bankruptcy was made public in the Danish Law Gazette on 11 May 2018.

Anyone having a claim against the estate is requested to lodge proof of such claim within four weeks. The claim must be calculated as at the bankruptcy date. The bankruptcy estate has continued the company’s operations. If you have a continuing contract/agreement and a decision needs to be made on assumption of the contract/agreement, please contact Assistant

Please lodge any proofs of claim with alpha@kammeradvokaten.dk with the headline „Proof of claim“.

Please enclose proper documentation for your claim as well as information about:

  1. the type of the claim and its amount
  2. the date of the accrual of your claim
  3. information and documentation about any special rights, including any claims to be a secured creditor or any other priority right
  4. information about the assets subject to any security

Your proof of claim must also include information about your CVR no.

The subsequent distribution of dividend, if any, is conditional on the trustee having received the Danish company’s CVR number, see section 7G of the Danish Tax Control Act.

If you lodge proof of your claim later than four weeks after 8 May 2018 there will be no sanctions, but it is possible to start the closing of the bankruptcy estate after that and any proofs of claim lodged after the process of closing the estate has started will be covered by any funds not yet distributed to the shareholders.

As soon as possible after the receipt of your proof of claim you will receive confirmation of such receipt.
